If you\u2019re injured, can the owner be held liable?<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Everyone has a reasonable expectation not to be injured when visiting someone else\u2019s property. In Ontario, if a property <\/span><a href=\"https:\/\/diamondlaw.ca\/what-you-need-to-know-about-ontario-premises-liability\/\"><span style=\"font-weight: 400;\">owner hasn\u2019t been responsible<\/span><\/a><span style=\"font-weight: 400;\"> for keeping others safe, then they can be held liable.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">When visiting someone\u2019s property, an injury resulting from <\/span><a href=\"https:\/\/diamondlaw.ca\/sidewalk-slip-fall-who-is-liable\/\"><span style=\"font-weight: 400;\">slipping and falling<\/span><\/a><span style=\"font-weight: 400;\"> due to unsafe conditions isn\u2019t uncommon. The owner could be liable for the damages arising from this incident. These claims are known as \u201coccupiers&#8217; liability\u201d claims.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">You may wonder: what is \u2018occupiers&#8217; liability\u2019?<\/span><\/p>\n<h2 dir=\"ltr\"><b>What is the Occupiers&#8217; Liability Act?<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">This act enforces a duty of care on the property\u2019s occupier to ensure that all visitors are reasonably safe when visiting their premises. An occupier could be considered someone who has adequate control over the <a href=\"https:\/\/diamondlaw.ca\/what-you-need-to-know-about-ontario-premises-liability\/\">premises<\/a> and could be more than one person.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">If any accidents result from the property\u2019s unsafe conditions, the act will deal with the liabilities that arise from it.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The \u2018duty of care\u2019 imposed by the Occupiers&#8217; Liability Act Ontario on the occupier ensures that visitors to the premises are reasonably safe at all times. The occupier should match the standard of care of a \u2018reasonable occupier\u2019 to the <a href=\"https:\/\/diamondlaw.ca\/contributory-negligence-in-ontario-injury-accidents\/\">common law negligence<\/a> standard of care.<\/span><\/p>\n<h2 dir=\"ltr\"><b>What are Property Owners\u2019 Legal Obligations Under the Occupier\u2019s Liability Act?<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">An occupier can be defined as someone who has a level of control over the premises. They don\u2019t need to reside on the property. The act also doesn\u2019t define the occupier as the legal owner. Since this owner has a degree of control of the property, they could be seen as an occupier.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The owner and\/or occupier has a responsibility to safeguard you as a visitor to their premises. These premises can include land, buildings, aircraft, vessels, and vehicles.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Examples of premises are listed below:<\/span><\/p>\n<ul>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Private homes and cottages<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Apartments and hotels<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/diamondlaw.ca\/what-to-do-if-you-are-injured-in-a-parking-lot-collision\/\"><span style=\"font-weight: 400;\">Parking lots<\/span><\/a><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Schools<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amusement parks<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Healthcare facilities<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Factories and offices<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Stores and restaurants<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Boats and travel trailers.<\/span><\/li>\n<\/ul>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The owners of properties aren\u2019t just responsible for maintaining their premises but also ensuring that their tenants and visitors are safe.If injuries occur due to a hazard that the tenant had control over, they could be held liable.<\/span><\/p>\n<h2 dir=\"ltr\"><b>Property Owners Exception to Liabilities\u00a0<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2021\/03\/Property-Owners-Exception-to-Liabilities-.jpg\" alt=\"\" width=\"868\" height=\"275\" class=\"size-full wp-image-9797 alignleft\" \/>If you were injured, the owner or occupier might not always be liable. If you were reckless and it resulted in your injury, then the <a href=\"https:\/\/diamondlaw.ca\/limits-of-owner-liability-for-injuries-on-recreational-property\/\">owner might not be liable<\/a>.<\/span><\/p>\n<ul>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Other exceptions are:<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The visitor assumes the risk, and there\u2019s no intention from the occupier to inflict harm on anyone.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A trespasser <\/span><a href=\"https:\/\/diamondlaw.ca\/what-responsibility-does-a-landowner-have-for-injuries-to-hikers-and-campers\/\"><span style=\"font-weight: 400;\">assumes any risk<\/span><\/a><span style=\"font-weight: 400;\"> when entering the premises.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A contractor can be held liable if their work at the premises caused the victim\u2019s injuries.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The injured party could be responsible for their condition due to being under the influence and behaving in a manner that the owner couldn\u2019t have foreseen.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Entering recreational areas for free is done at your own risk.
