However, homeowner responsibilities under the\u00a0<a href=\"http:\/\/www.ibc.ca\/en\/Business_insurance\/risk_management\/Occupiers_Liability.asp\" rel=\"nofollow noopener\" target=\"_blank\">Occupiers Liability Act<\/a>\u00a0are quite substantial.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">If an individual suffers a personal injury, such as a\u00a0<a href=\"https:\/\/diamondlaw.ca\/practice-areas\/slip-and-fall\">slip and fall<\/a>, due to a homeowner\u2019s failure to attend to their icy or snowy walkway, they can be at risk of a lawsuit.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">It is important to note that the term \u201coccupier\u201d also extends to tenants of a property since they technically occupy it (for those of you renting, you are also responsible for taking care of the premise). In a lawsuit, it is possible for liability to be shared between a tenant and a landlord. The person or persons who are held liable will depend on the circumstances around the loss.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Under the act the occupiers must try to maintain \u201creasonable care\u201d of the property which includes things such as providing adequate lighting, clearing debris and attending to uneven surfaces.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><br \/>During the winter months the act also mentions hazardous conditions such as:<\/p>\r\n\r\n\r\n\r\n<ol class=\"wp-block-list\">\r\n<li>ice and snow that hasn\u2019t been cleared;<\/li>\r\n<li>slippery surfaces.<\/li>\r\n<\/ol>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Occupier\u2019s exposure under these claims can be substantial so it is crucial that they work diligently to keep their property free from any hazards.
