






{"id":2430,"date":"2014-12-02T08:00:06","date_gmt":"2014-12-02T08:00:06","guid":{"rendered":"http:\/\/68.183.99.185\/diamondlaw-ca\/?p=2430"},"modified":"2019-02-02T10:34:59","modified_gmt":"2019-02-02T10:34:59","slug":"new-auto-insurance-legislation-how-does-it-impact-you","status":"publish","type":"post","link":"https:\/\/diamondlaw.ca\/new-auto-insurance-legislation-how-does-it-impact-you\/","title":{"rendered":"New Auto Insurance Legislation: How Does it Impact You?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On November 20, 2014, Ontario passed the \u201cFighting Fraud and Reducing Automobile Insurance Rates Act, 2014 (Act).\u201d According to the&nbsp;<a href=\"http:\/\/news.ontario.ca\/mof\/en\/2014\/11\/auto-insurance-legislation-passes-will-help-reduce-costs-and-fight-fraud.html\" rel=\"nofollow noopener\" target=\"_blank\">Ontario Ministry of Finance<\/a>, \u201c[The intended aim of this Act is to] help the provincial government fight fraud and abuse, reduce costs and uncertainty in the auto insurance system and protect more than nine million licensed drivers across the province.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act\u2019s goals are to keep the auto insurance system fair, reliable and affordable by:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Increasing the claims settlement process speed to help injured Ontario drivers.<\/li><li>Providing consumer protections specific to towing and vehicle storage.<\/li><li>Authority for the province to change the current 60-day period that a vehicle can be stored after an accident.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These changes will help contribute to lower claim costs for insurers and reduce rates for drivers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<a href=\"http:\/\/www.thestar.com\/news\/queenspark\/2014\/11\/20\/new_auto_insurance_legislation_restricts_right_to_sue_critics.html\" rel=\"nofollow noopener\" target=\"_blank\">Toronto Star<\/a>&nbsp;recently posted an article on the new auto insurance legislation and spoke to a member of the Ontario Trial Lawyers association (OTLA).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the Act provides some new protections to consumers, OTLA argues that the legislation removes a motorists\u2019 right to sue an insurance company for denying their claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Steve Rastin, president of the OTLA, \u201cWe are profoundly disappointed in the government for what they did today\u201d in relation to the clause that replaced the right to sue for denied claims with an arbitration system. He points out that this will be both costly and time consuming.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rastin and the OTLA support most of what is in the bill, however, a few key points are unacceptable: the right to sue and reduced interest rates for injured claimants.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The then-minority Liberal government agreed to an NDP demand for a 15 per cent cut in car insurance rates over two years in order to get the Ontario provincial budget passed. In the last year, auto insurance rates have dropped 6 percent.
