






{"id":2182,"date":"2013-08-03T08:00:56","date_gmt":"2013-08-03T08:00:56","guid":{"rendered":"http:\/\/68.183.99.185\/diamondlaw-ca\/?p=2182"},"modified":"2022-01-06T17:36:13","modified_gmt":"2022-01-06T17:36:13","slug":"pool-death-prompts-possible-legal-action","status":"publish","type":"post","link":"https:\/\/diamondlaw.ca\/pool-death-prompts-possible-legal-action\/","title":{"rendered":"Pool Death Prompts Possible Legal Action"},"content":{"rendered":"\r\n<p class=\"wp-block-paragraph\">Toronto Sun<br \/>Jenny Yuen<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Parents want registration fees back!<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">A group of 10 parents are threatening legal action against a Vaughan camp \u2013 where a four-year-old was found unconscious on a pool \u2013 if staff refuse to refund them their registration fees.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The unnamed little girl was pulled from the pool Tuesday at Pavilion Fitness Club \u2013 Near Dufferin St. and Hwy. 407- and died in the hospital Friday morning.<\/p>\r\n\r\n\r\n\r\n<h2>No Negligence, No Refunds<\/h2>\r\n<p class=\"wp-block-paragraph\">The group of concerned parents claimed they were told by the Pavilion over the weekend, which runs the Kidz Klub drop-in camp, there would be no refunds issued because the staff were not negligent.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">&#8220;Obviously, the parents have issues about sending their kids back to the camp,&#8221; said the families&#8217; lawyer Sandra Zisckind, of the firm Diamond and Diamond.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The parents of the dead girl are not included in the group.<\/p>\r\n<p>Zisckind said the group is waiting to hear from the camp directors before pursuing legal action.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">&#8220;We&#8217;re waiting to see what occurs in the next week,&#8221; she said. &#8220;If they are going to refund the money to the parents and make any necessary compensation, then clearly a lawsuit isn&#8217;t necessary.&#8221;<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">The parents, who have children ranging in age between four and seven, are looking for compensation of $700 to $1,000.<\/p>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">A spokesman for Pavilion could not be reached Sunday.
