As of 2021, reports show that <\/span><a href=\"https:\/\/tc.canada.ca\/en\/road-transportation\/statistics-data\/canadian-motor-vehicle-traffic-collision-statistics-2021\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">28.6 percent of driver and 35.6 percent of passenger fatalities<\/span><\/a><span style=\"font-weight: 400;\"> have happened because of not wearing seat belts.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">All Canadian seat belt laws are primary enforcement laws, which means that not wearing a seat belt is enough for the police to pull you over and issue a citation. The typical penalty for not wearing a seat belt is a fine, demerit points, or both. Ontario&#8217;s fine is between $200 to $1,000 and two demerits.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Before seat belt laws came into effect, most people in Canada didn\u2019t wear them. For example, <\/span><a href=\"https:\/\/www.cbc.ca\/news\/canada\/edmonton\/june-22-1987-albertans-prepare-for-seatbelt-law-1.3649730\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">only 28 percent of Albertans wore seat belts in 1987<\/span><\/a><span style=\"font-weight: 400;\">, when seat belts became mandatory. The latest information indicates that <\/span><a href=\"https:\/\/tc.canada.ca\/en\/road-transportation\/publications\/archived\/road-safety-canada#s31\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">90 percent or more people use seat belts across Canada<\/span><\/a><span style=\"font-weight: 400;\">, including Alberta (92 percent). However, seat belts continue to save more lives than all other safety measures combined. The<\/span><a href=\"https:\/\/www.history.com\/this-day-in-history\/three-point-seatbelt-inventor-nils-bohlin-born\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">standard three-point seatbelt<\/span><\/a><span style=\"font-weight: 400;\"> we take for granted today is a result of these studies. Data from The National Highway Traffic Safety Administration (NHTSA) provides more or less the same information.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The following statistics show just how important seat belts are in Canada:<\/span><\/p>\n<ul>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www150.statcan.gc.ca\/t1\/tbl1\/en\/tv.action?pid=1310039401&amp;pickMembers%5B0%5D=2.22&amp;pickMembers%5B1%5D=3.1&amp;cubeTimeFrame.startYear=2020&amp;cubeTimeFrame.endYear=2020&amp;referencePeriods=20200101%2C20200101\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Accidents were the leading cause of death<\/span><\/a><span style=\"font-weight: 400;\"> in Canada for ages 15 to 24 in 2020.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Front-seat passengers using seat belts<\/span><a href=\"https:\/\/tc.canada.ca\/en\/road-transportation\/publications\/archived\/road-safety-canada#star3\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">reduce the risk of a fatal injury<\/span><\/a><span style=\"font-weight: 400;\"> by 47 percent and moderate to critical injury by 52 percent.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">British Columbia has the highest rate of seatbelt use (96.9 percent), followed by Saskatchewan (96.8 percent), Ontario (96 percent), and Quebec (96 percent).<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ontario had the lowest fatality rate per 100,000 population (3.8) in 2021, Prince Edward Island had the highest (10.5).<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">More people died in motor vehicle accidents in<\/span><a href=\"https:\/\/tc.canada.ca\/en\/road-transportation\/statistics-data\/canadian-motor-vehicle-traffic-collision-statistics-2021\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">rural (54 percent) than in urban (44.67 percent)<\/span><\/a><span style=\"font-weight: 400;\"> areas. On the other hand, more people sustained personal injuries in urban areas (72.5 percent) than in rural areas (25.1 percent).<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fewer pickup and light truck drivers and passengers (92 percent) use seat belts than those in minivans, cars, and SUVs (95.3 percent national average).<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Significantly fewer back-seat passengers (89.2 percent) buckle up than those in front (95.5 percent).<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Female drivers wear seat belts (96 percent)\u00a0 men (94.3 percent).<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Travel restrictions during the pandemic resulted in an<\/span><a href=\"http:\/\/www.virginiadot.org\/newsroom\/statewide\/2020\/volume-down-on-virginia-roadways%C2%A0while-unbelted-and-speed-related-crashes-and-fatalities-increase%C2%A06-19-2020.asp\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">increase in unrestrained fatalities (from 41 to 70 percent) in speed-related accidents<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">These statistics prove how important seat belts are for ensuring maximum safety. A substantial number of people would be alive today if they had been wearing seat belts at the time of their car accident.<\/span><\/p>\n<h2 dir=\"ltr\"><b>Why should you use seat belts?<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Most Canadians accept that they should wear seat belts because it\u2019s an offence not to. However, they might not know why we have seat belt laws.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Numerous global and Canadian studies have consistently found that seat belts can save lives. According to Transport Canada,<\/span><a href=\"https:\/\/canadasafetycouncil.org\/safety-on-the-road-ahead\/\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">seat belts save approximately 1,000 lives annually in Canada<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">While seat belt use is widespread, about 3 to 21 percent of individuals don&#8217;t wear them, depending on the province. About 40 percent of those who died in passenger<\/span><a href=\"https:\/\/diamondlaw.ca\/practice-areas\/car-accidents\/\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">car accidents<\/span><\/a><span style=\"font-weight: 400;\"> weren\u2019t wearing seatbelts.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Canadian law enforcement considers failing to wear a seat belt as one of the leading causes of death on the road. About a third<\/span><a href=\"https:\/\/tc.canada.ca\/en\/road-transportation\/statistics-data\/canadian-motor-vehicle-traffic-collision-statistics-2018\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">(29.4 percent) of driver fatalities and 10.8 percent of serious injuries<\/span><\/a><span style=\"font-weight: 400;\"> were due to not buckling up in 2018. Unbuckled car occupants are more likely to die (32.1 percent) or get seriously hurt (18.4 percent). Other contributing factors include impaired driving, distracted driving, and aggressive driving.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Seat belts have the following benefits:<\/span><\/p>\n<ul>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They keep you from being expelled in motor vehicle crashes.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They shield you from the significant force when an airbag deploys, which can cause severe injuries if you\u2019re not restrained by a seat belt.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They keep passengers safe in a potentially fatal crash.<\/span><\/li>\n<li dir=\"ltr\" style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They help to prevent<\/span><a href=\"https:\/\/www.thinkinsure.ca\/insurance-help-centre\/tickets-and-car-insurance-rates-in-ontario.html\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">increases in car insurance premiums<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Instead of using public transportation, most Canadians drive to work. About<\/span><a href=\"https:\/\/www.statcan.gc.ca\/o1\/en\/plus\/2697-gta-getting-there-automobile\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">73.8 percent of Ontarians took a car<\/span><\/a><span style=\"font-weight: 400;\">, van, or truck to work in 2022. Therefore, wearing a seat belt to ensure maximum safety is very important.<\/span><\/p>\n<p><iframe loading=\"lazy\" width=\"100%\" height=\"400\" src=\"https:\/\/www.youtube.com\/embed\/vRU1bokFges?si=cI3qzsfVA8ZTpDGZ\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h2 dir=\"ltr\"><b>Seat Belt History<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">British engineer,<\/span><a href=\"https:\/\/www.britannica.com\/biography\/Sir-George-Cayley\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">George Cayley<\/span><\/a><span style=\"font-weight: 400;\"> of Yorkshire, invented and pioneered many things, including the seat belt. He developed what was essentially a strap to keep pilots secure in gliders.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The transition to passenger vehicles happened in 1885, with a<\/span><a href=\"https:\/\/patents.google.com\/patent\/US312085A\/en\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">design patented by American engineer, Edward J. Claghorn<\/span><\/a><span style=\"font-weight: 400;\">. The seat belt then debuted in 1922 during the<\/span><a href=\"https:\/\/www.wired.com\/2016\/05\/8-wild-ideas-debuted-indy-500-seat-belts-mirrors\/\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">Indy 500<\/span><\/a><span style=\"font-weight: 400;\">. However, these seat belts were mainly straps worn across the lap that didn\u2019t adequately protect the torso.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The three-point seat belt that we use today came out in 1959 and was perfected by Volvo engineer, Nils Bohlin. <\/span><a href=\"https:\/\/www.cnet.com\/roadshow\/news\/55-years-ago-today-volvo-received-a-patent-that-saved-countless-lives\/\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Bohlin received a patent in 1962<\/span><\/a><span style=\"font-weight: 400;\">, and his design had one strap across the hip and one across the torso, which secured the person at three points.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Before Bohlin received the patent, Wisconsin passed the<\/span><a href=\"https:\/\/www.wpr.org\/surprisingly-controversial-history-seat-belts\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">first official seat belt law in 1961<\/span><\/a><span style=\"font-weight: 400;\">, but it wasn&#8217;t without controversy. Younger people (16-24) and passengers are less likely to wear seat belts while in a motor vehicle.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Time and day<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">A significant risk factor for seat belt wear is the time and day individuals are in a motor vehicle. More people tend to use their seat belts during daytime, resulting in fewer fatalities during daytime accidents. They also tend to use seat belts more during weekdays.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">One explanation could be that since seat belts are mandatory in Canada, police officers can see if people aren\u2019t wearing seat belts during the day. Another is that most people who travel during the weekdays and daytime are older people, who tend to wear seat belts anyway, on their way to work.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Distance, speed, and weather<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">While most people wear seat belts when they know they\u2019re in for a long drive, some tend to forget to wear seat belts when they\u2019re travelling short distances. People also tend to remember to wear seat belts on the highway and in bad weather.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Location<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">All Canadian provinces and territories mandate seat belt use. However, motorists in some areas are more likely to follow the law than in other areas. The seat belt use rate is highest in British Columbia and lowest in Yukon. People who live in rural areas are also less likely to wear seat belts than those in urban locations.\u00a0<\/span><\/p>\n<h3 dir=\"ltr\"><b>Age<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Young people tend to think that nothing bad can happen to them and engage in risky behaviour. One of these behaviours is not wearing seat belts. Only 64 percent of people between 16 and 24 wear seat belts, compared to 83.6 percent among people 65 and older.<\/span><\/p>\n<h2 dir=\"ltr\"><b>Do Canadians commonly drive unbuckled?<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Though most Canadians wear seat belts, about 3 to 21 percent don\u2019t, and that\u2019s a problem. At least 1.1 million people are at risk of preventable serious injuries and fatalities. Most Canadians believe that seat belts can save lives. Young people might believe that they\u2019re invincible, but that\u2019s not true.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Of the fatalities reported in 2021, 151 were under 19. While bad weather, bad drivers, and bad roads can lead to accidents, these are beyond a driver&#8217;s control. What isn\u2019t beyond a driver\u2019s control is making sure that everyone in the vehicle is buckled up.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Some people, however, don&#8217;t like the seat belt strap going over their shoulders, so they put them behind their backs or under their arms. However, if you do that, the seat belt won\u2019t work as intended in case of an accident.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">For example, if you hit another vehicle at high speed, the seat belt won\u2019t keep you from being thrown out of the windshield, which is almost always fatal. If you don\u2019t wear a seat belt properly, it\u2019s like you\u2019re not wearing one at all.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Death and injury<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The most concerning issue with not wearing seat belts is the death and injury of passengers and drivers. Many preventable deaths and injuries from traffic accidents happen annually because of not wearing seat belts.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">In 2021,<\/span><a href=\"https:\/\/tc.canada.ca\/en\/road-transportation\/statistics-data\/canadian-motor-vehicle-traffic-collision-statistics-2021\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">1,768 people died<\/span><\/a><span style=\"font-weight: 400;\"> and 116,203 people sustained injuries from motor vehicle accidents in Canada. About two-thirds (64.2 percent) of people who died weren\u2019t wearing seat belts at the time of the accident.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Even if just one person isn\u2019t wearing a seat belt, others in the vehicle can die or sustain serious injuries. This is because three different collisions happen in a car accident. Of course, the first is the vehicle when it hits another object, such as another car, a tree, or a wall. The second is humans when passengers hit things in the car. The last is internal, when the person&#8217;s internal organs, including the brain, move around.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The dynamics of a car accident are interesting. When a car suddenly stops because it hits something, everything else in the vehicle continues to move forward at the same speed. For example, If you\u2019re travelling on a highway at 100 kph and rear-end another car, you and everything else in your vehicle continue to travel at 100 kph until something stops you. Seat belts do that in concert with airbags.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">However, a person who isn\u2019t wearing a seat belt has nothing to stop them. They may hit the back of a seat, the front windshield, or another occupant. Not only will they suffer serious injuries, but they\u2019ll also injure everyone they hit.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">When colliding with others, a 150-pound unrestrained adult can exert as much force as a 3.5-ton truck. Moreover,<\/span><a href=\"https:\/\/injuryprevention.bmj.com\/content\/10\/6\/363\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">belted occupants are 4.8 times more at risk of injury and death<\/span><\/a><span style=\"font-weight: 400;\"> with someone who isn\u2019t wearing a seat belt during an accident.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Increased medical costs<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">While death is the ultimate tragedy from not wearing a seat belt, injuries can also be devastating. Unbelted car accident victims tend to have more severe injuries than those wearing a seat belt, which also means higher medical bills. The trauma of being ejected from a vehicle can have significant physical, mental, and emotional effects.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">One US study compared the<\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/2760959\/\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">medical costs of restrained and unrestrained car accident victims<\/span><\/a><span style=\"font-weight: 400;\">. It indicated that unrestrained victims were 59 percent more likely to be hospitalized, and that they also needed to stay in the hospital three days longer.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The<\/span><a href=\"https:\/\/reference.medscape.com\/calculator\/356\/injury-severity-score\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">injury severity scores<\/span><\/a><span style=\"font-weight: 400;\"> (ISS) for unrestrained victims were 8.28 compared to 4.44 for restrained victims. Furthermore, 20 percent more for those with an ISS of 15 or more were unrestrained victims.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As you can imagine, more extended hospital stays, high ISS scores, and requiring more intensive medical care mean higher bills. The annual<\/span><a href=\"https:\/\/diamondlaw.ca\/car-accident-statistics.html\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">cost of car accidents<\/span><\/a><span style=\"font-weight: 400;\"> in Canada in 2021 was more than $25 billion. While not all the cost is attributable to unrestrained victims, a significant portion of these expenses could have been easily prevented.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126.jpg\" alt=\"\" width=\"1920\" height=\"1280\" class=\"alignnone size-full wp-image-13053\" srcset=\"https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126.jpg 1920w, https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126-300x200.jpg 300w, https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126-1024x683.jpg 1024w, https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126-768x512.jpg 768w, https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126-1536x1024.jpg 1536w, https:\/\/diamondlaw.ca\/wp-content\/uploads\/sites\/8\/2023\/09\/pexels-anna-shvets-3845126-1568x1045.jpg 1568w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<h3 dir=\"ltr\"><b>Lower personal injury settlements<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Canadian courts are generally skeptical in negligence claims. They have consistently reduced compensation when victims contribute to the accident.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Sometimes, they even dismiss the case, which the Supreme Court of Canada did in<\/span><a href=\"https:\/\/scc-csc.lexum.com\/scc-csc\/scc-csc\/en\/item\/1122\/index.do\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><i><span style=\"font-weight: 400;\">Galaske v O&#8217;Donnell<\/span><\/i><\/a><span style=\"font-weight: 400;\">. The plaintiff was a child who wasn\u2019t wearing a seatbelt at the time of the accident. The child was with a parent who wasn\u2019t the driver. The respondent\u2019s defence was that the parent should have insisted that the child wear a seat belt.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">However, most cases aren\u2019t so drastic. Take, for example,<\/span><a href=\"https:\/\/www.casemine.com\/judgement\/uk\/5a8ff70360d03e7f57ea59a5\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><i><span style=\"font-weight: 400;\">Froom v Butcher<\/span><\/i><\/a><span style=\"font-weight: 400;\">, which is a case from 1975. Since the plaintiff wasn\u2019t wearing a seat belt, the judge reduced the award by 20 percent, saying that they contributed to the accident.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The reduction of damages for not wearing a seat belt will depend on the case and the skill of your<\/span><a href=\"https:\/\/diamondlaw.ca\/\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">personal injury lawyer<\/span><\/a><span style=\"font-weight: 400;\">. However, it typically falls between 5 and 25 percent.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Unrestrained crash victims can still file personal injury lawsuits. However, they must accept that their award of damages may be reduced. They may also need to provide evidence that not using a seat belt did not contribute in any way to the injury.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Increased insurance rates<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Insurance companies consider the risks they take when issuing policies to drivers. When calculating insurance rates, these companies look at any offences, including seat belt tickets.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">While one seat belt ticket may not significantly impact your premium, repeated offences might. A seat belt ticket is a minor offence, typically resulting in fines and demerits on your driving record.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">In Ontario, you get<\/span><a href=\"https:\/\/www.ontario.ca\/page\/understanding-demerit-points\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">two demerits on your license for not wearing a seat belt<\/span><\/a><span style=\"font-weight: 400;\">. If, however, you have a full driver\u2019s licence and get over 15 demerit points within two years, your licence will be suspended for 30 days and you\u2019ll need to surrender your licence to the Ontario Ministry of Transportation.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Insurance companies track demerits to determine the type of tickets you get. A ticket for stunt driving or speeding may require you to go to court. If you get a conviction, your insurance rate will significantly increase.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Seat belt tickets won\u2019t directly lead to higher premiums. However, if you get a license suspension for any reason, such as too many demerits, it may. Sometimes, insurers may even refuse to cover you for suspensions due to risky behaviour, such as impaired driving.<\/span><\/p>\n<h2 dir=\"ltr\"><b>Seat Belt Laws<\/b><\/h2>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Provinces and territories have their own laws regarding the use of seat belts. Since they\u2019re all primary enforcement laws, police are allowed to pull you over for not wearing a seat belt.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Below is a brief description of seat belt laws in Canada by province. Note that each jurisdiction provides specific exemptions.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Ontario<\/b><\/h3>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Seat belts date back to the 1800s. However, it was only in 1976 that the first seat belt law was passed in North America.<\/span><a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90h08#BK196\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/a><\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90h08#BK196\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 106<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Highway Traffic Act<\/span><\/i><span style=\"font-weight: 400;\"> requires all persons 16 and older in a motor vehicle to wear a seat belt. The driver is responsible for ensuring passengers under 16 are wearing a seat belt. Moreover, it must be a three-point seat belt assembly, as specified under<\/span><a href=\"https:\/\/laws.justice.gc.ca\/eng\/regulations\/C.R.C.%2C_c._1038\/FullText.html\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\"> <\/span><span style=\"font-weight: 400;\">Section 208 (1)<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Motor Vehicle Safety Act<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Alberta<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.canlii.org\/en\/ab\/laws\/regu\/alta-reg-122-2009\/latest\/alta-reg-122-2009.html#Part_5_Occupant_Restraint_Systems_124974\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Part 5<\/span><\/a><span style=\"font-weight: 400;\"> of the Alberta <\/span><i><span style=\"font-weight: 400;\">Traffic Safety Act<\/span><\/i><span style=\"font-weight: 400;\"> specifies that all drivers and passengers must wear a seatbelt. The driver is responsible for securing children from 6 to 15.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Drivers with learner or probationary (GDL) licenses may not have more passengers than seatbelts. Children under six, or who weigh less than 18 kgs, must be in an approved child restraint. Drivers who violate these rules may receive a $162 fine. GDL drivers get two demerit points for having more passengers than seat belts.<\/span><\/p>\n<h3 dir=\"ltr\"><b>British Columbia<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/96318_07\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 220<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Motor Vehicle Act<\/span><\/i><span style=\"font-weight: 400;\"> requires everyone in a motor vehicle to wear a seat belt. The seat belt must include a pelvic restraint, upper torso restraint, or both. Persons in vehicle seats with separate pelvic and torso restraints may only use the pelvic restraint. Children under six must be in a child seat that\u2019s also securely restrained.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The penalty for not wearing a seatbelt is $167, plus a 15 percent surcharge, for each unrestrained person in the vehicle. You\u2019ll also be fined $311, plus victim surcharges, if you have more passengers than seat belts. If, however, you pay the fine within 30 days, your fine will be reduced by $25.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Manitoba<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.canlii.org\/en\/mb\/laws\/stat\/ccsm-c-h60\/latest\/attachment\/h60.pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 186<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Highway Traffic Act<\/span><\/i><span style=\"font-weight: 400;\"> of Manitoba requires all drivers and passengers to wear a seat belt. Depending on the minor\u2019s age, drivers must make sure that they\u2019re safe in either child restraint seats or an adult seat belt assembly. They shouldn\u2019t secure child car seats or booster seats to the vehicle with automatic seat belt assemblies.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Unrestrained drivers and passengers may be liable for a fine of up to $2,000.<\/span><\/p>\n<h3 dir=\"ltr\"><b>New Brunswick<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.canlii.org\/en\/nb\/laws\/regu\/nb-reg-83-163\/latest\/nb-reg-83-163.html\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 200.1<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Motor Vehicle Act <\/span><\/i><span style=\"font-weight: 400;\">requires all motor vehicle passengers to wear a seat belt. The vehicle can\u2019t have more passengers than seat belts.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">It\u2019s the driver&#8217;s responsibility to make sure that passengers aged 9 to 15 are secured. Children up to 8 years old, 36 kgs, or 145 cm, must be in child safety seats.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">If the driver isn\u2019t wearing a seat belt, they may be fined $180 and get two demerit points.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Newfoundland and Labrador<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.assembly.nl.ca\/legislation\/sr\/statutes\/h03.htm#178_\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 178<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Highway Traffic Act<\/span><\/i><span style=\"font-weight: 400;\"> requires all persons in a vehicle on a highway to wear seat belts. The driver can\u2019t have more passengers than seat belts. Children up to eight years old must be in a child seat restraint system.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Violating any part of this provision can result in a minimum fine of $100 and a maximum fine of $500.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Northwest Territories<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.justice.gov.nt.ca\/en\/files\/legislation\/motor-vehicles\/motor-vehicles.a.pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 146<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Motor Vehicles Act<\/span><\/i><span style=\"font-weight: 400;\"> requires all persons in a motor vehicle to wear a seat belt. Drivers are responsible for making sure that everyone under 15 is wearing a seat belt. Children of a &#8220;prescribed&#8221; size or weight must stay in a child restraint system.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Failure to wear a seat belt carries a fine of $172.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Nova Scotia<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/nslegislature.ca\/sites\/default\/files\/legc\/statutes\/motor%20vehicle.pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 175<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Motor Vehicle Act<\/span><\/i><span style=\"font-weight: 400;\"> doesn\u2019t require drivers or passengers 16 and older to wear a seat belt if it\u2019s not available. However, the driver must make sure that a passenger under 16 is wearing a seat belt. Children of a prescribed weight and age must be in a child restraint system.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">The first offence under this section carries a fine of $180 and two demerits. The penalty for the second offence is $237.50, and $352.50 for the third offence.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Prince Edward Island<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.princeedwardisland.ca\/sites\/default\/files\/legislation\/h-05-highway_traffic_act.pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 92<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Highway Traffic Act<\/span><\/i><span style=\"font-weight: 400;\"> requires passengers to wear seat belts if they\u2019re available. Drivers must secure young children in an appropriate child restraint system.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">There\u2019s a fine of $200 to $500 for violating this provision.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Quebec<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/en\/document\/cs\/c-24.2#se:395\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 395-397<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Highway Safety Code<\/span><\/i><span style=\"font-weight: 400;\"> requires everyone in the vehicle to wear a seat belt. Children under nine, or less than 145 cm, must be in a child restraint or booster seat. However, a child seat is not mandatory if the vehicle has no provision.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Violating these sections will result in a fine ranging from $200 to $300 and three demerits.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Saskatchewan<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/www.canlii.org\/en\/sk\/laws\/stat\/ss-2004-c-t-18.1\/latest\/ss-2004-c-t-18.1.html?docType=pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 248<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Traffic Safety Act <\/span><\/i><span style=\"font-weight: 400;\">requires drivers and passengers 16 and older to wear a seat belt if they\u2019re available. It\u2019s the driver\u2019s responsibility to make sure that passengers under 16 are wearing a seat belt. Children under seven, weighing 18 to 36 kgs or who are less than 145 cm, must be in a booster seat. Children less than 18 kgs must be in an appropriate child restraint system.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-weight: 400;\">Violating this provision carries a fine of $175 and three demerits.<\/span><\/p>\n<h3 dir=\"ltr\"><b>Yukon<\/b><\/h3>\n<p dir=\"ltr\"><a href=\"https:\/\/laws.yukon.ca\/cms\/images\/LEGISLATION\/PRINCIPAL\/2002\/2002-0153\/2002-0153.pdf\" rel=\"nofollow noopener\" target=\"_blank\"><span style=\"font-weight: 400;\">Section 198<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Motor Vehicles Act<\/span><\/i><span style=\"font-weight: 400;\"> requires all persons in the vehicle to wear seat belts. Car owners must also make sure that all seat belts are operative.
